Business Energy Expert is a free service that introduces Australian businesses to energy brokers and retailers. This website is operated by Comparison Advantage Pty Ltd ACN 626 309 073 (we, us, our). These terms apply whenever you use this website or request a quote. If you do not agree with them, please do not use the service.
1. About these terms
By using this website or submitting a quote request, you agree to be bound by these terms, which form a binding agreement between you and us. We may update them from time to time by posting a revised version on this page, and continuing to use the service after that means you accept the change.
Our Privacy Policy also applies to your use of the service.
2. Who can use the service
You must be at least 18 years old and have the legal capacity to enter into contracts. Our service is for commercial energy users, not residential customers. If you use the service on behalf of a business, you confirm that you are authorised to do so.
3. How the service works
Requesting quotes. You complete a form on this website with details about your business and your energy needs, and you may choose to upload a recent bill or provide your NMI.
Confirming your details. We may contact you by phone, email or SMS to confirm your details and understand what you need, at no cost to you.
Introductions. We then pass your details to one or more partner energy brokers or retailers (Partners), who will contact you with quotes and may follow up about them.
What it costs you. Our service is free to you. Partners pay us an introduction fee for referrals, which does not change what you pay them.
What we are not. We are not an energy retailer or broker, we do not sell energy, and we do not provide financial, legal or energy procurement advice. Information on this website is general in nature.
4. Your responsibilities
When you use the service, you agree:
- to give us true, current and complete information, and to only submit details for a business you are authorised to act for
- not to use the service for anything unlawful, fraudulent, misleading or abusive
- not to send spam or unsolicited commercial content through the service
- not to copy, reproduce, adapt or modify this website or its content without our written consent, and not to scrape it or make automated use of it
- not to interfere with the security or normal operation of the website, including by probing for vulnerabilities, introducing malicious code, or attempting to access other users’ data
5. Our content
Unless we say otherwise, everything on this website, including text, graphics, logos, icons and software, is owned by or licensed to us and protected by intellectual property laws. You may use it only as needed to use the service. Third party logos shown on this website remain the property of their owners and are used to identify retailers our Partners work with.
6. Partners and third parties
We introduce businesses to Partners. We are not a party to any contract between you and a Partner. You acknowledge that:
- any quote, agreement, product or service you take up is solely between you and the Partner or retailer
- an introduction is not an endorsement or recommendation of any Partner, retailer or plan
- we do not verify or warrant the licensing, competence, solvency or conduct of any Partner
- quotes are prepared by the Partner and can change without notice
- we do not guarantee any saving, rate or other financial outcome from using the service
This website may contain content from and links to third party websites. We do not control that content and are not responsible for it.
7. Complaints and disputes
If you have an issue with a Partner or a quote, raise it directly with them first. If you cannot resolve it, let us know and we will make reasonable efforts to help.
If you have a complaint about your energy retailer that you cannot resolve with them, you can contact the energy ombudsman in your state or territory.
8. Availability of the service
The service is provided on an “as is” basis. We do not guarantee that this website will be free of errors, that it will always be available, that messages sent through it will always be delivered, or that information provided through it is accurate or complete.
We are not responsible for loss or damage to your systems or data arising from your use of the service, and you should maintain your own security precautions.
9. Liability
Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded. Where a non-excludable guarantee applies, our liability is limited, at our option, to supplying the service again or paying the cost of having it supplied again.
Otherwise, to the maximum extent permitted by law, our total liability to you for any loss or damage arising from the service is limited to $100 (AUD) in aggregate, and we are not liable for indirect or consequential loss, including loss of profits, revenue, anticipated savings, goodwill or business opportunity.
You agree to indemnify us against any liability arising from your misuse of the service or your breach of these terms.
10. Reporting misuse
If you notice misuse of this website, an error in its content, or a problem accessing it, please tell us at info@businessenergyexpert.com.au or 1300 096 283.
11. General
Waiver. A right under these terms is only waived if we do so in writing.
Assignment. You cannot transfer your rights or obligations under these terms without our consent.
Governing law. These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have exclusive jurisdiction over any dispute.
Survival. The sections covering liability, our content and this general section survive any end to these terms.
